Proposition 65 contains a unique “citizen-suit” enforcement provision that allows trial lawyers to rake in millions of dollars from businesses who knowingly or unknowingly fail to meet all of Prop 65’s requirements. In many cases, the exposure limits required by Prop 65 are lower than what occurs naturally. Lead, for example, is found in natural proteins, plants, and minerals. Not a lot, but a measurable amount because plants absorb metals and other trace chemicals from the soil in which they’re grown.
